Millions of Americans suffer from blood clots and strokes every day. In order to prevent these conditions from occurring, physicians often prescribe a blood thinner. A popular type of blood thinner medication is Xarelto. Many choose Xarelto over other blood thinners such as Warfarin for convenience purposes, because you don’t need the frequent monitoring or monthly blood tests such as you do while taking Warfin.  However, unlike its competitors, the drug does not have a reversal agent. This could be a danger as blood thinners could cause intense bleeding. In fact, Xarelto has a black box warning, the most serious type of caution by the FDA, due to its risk of stroke for patients that stop taking it prematurely. Drug manufacturers of the medication, Johnson & Johnson and Bayer, may have distorted the safety of taking Xarelto and failed to warn users of its risk of uncontrollable bleeding. For this reason, thousands are coming forward to join the Xarelto lawsuit.

Xarelto Lawsuit Update

Last year, we published a blog post about the risks and complications of taking Xarelto. Since then, the Xarelto lawsuit has grown and thousands are coming forward to accuse Johnson & Johnson and Bayer of putting their life at risk.

Currently, there are an estimated 18,000 lawsuits in federal and state courts related to Xarelto. The FDA estimates the drug has been linked to at least 370 deaths. In its first bellwether trial just last week, there was a finding by a New Orleans federal jury in favor of the manufacturers. This was a disappointment for patients harmed as a result of taking Xarelto. Plaintiff’s lawyers, however, are still maintaining that Johnson & Johnson and Bayer failed to adequately warn the medical community and public of Xarelto’s risks.  The next bellwether trial will also be held in Louisiana and is expected to begin on May 30, 2017. A third trial is scheduled in the U.S. District Court of Mississippi to begin at some point in June. Also, a fourth trial is anticipated to begin in Texas the following month.

How Much Could a Xarelto Lawsuit Settlement be Worth?

In another recent lawsuit Bayer faced, the manufacturer ended litigation for their line of birth controls known as Yaz, Yasmin, and Ocella in 2015. They settled the 1,200 claims for $56.9 million dollars for their medications that allegedly caused blood clots, strokes, and heart attacks in women.

Just this week in Johnson & Johnson’s infamous talcum powder lawsuit, the manufacturer was ordered to pay a record-setting verdict of $110.5 million to a woman from Virginia who claims to have developed ovarian cancer after using the company’s product for decades.

In a lawsuit comparable to Xarelto, blood thinner Pradaxa has had settlements reaching $650 million dollars in compensation for causing similar excessive bleeding. On average, each plaintiff received about $162,500. Research by JAMA Internal Medicine has shown that Xarelto is even more dangerous. This means there is a possibility that a favorable Xarelto lawsuit settlement may result in equally high rulings.

Do I Qualify for the Xarelto Lawsuit?

There are several ways you may qualify for the Xarelto lawsuit. Because it was deemed safer and more effective than its competitors, many doctors prescribed the drug to their patients. If you took Xarelto and developed any of the negative side effects listed above including uncontrollable bleeding or stroke, you may be eligible to join the case. You should consult with a personal injury lawyer to learn more about your possible case.
