Case update:

On February 14, 2023, Plaintiffs’ lawyers in a national multidistrict litigation (MDL) against some of the world’s largest social media platforms filed a master complaint meeting a deadline set by federal judge Yvonne Gonzalez-Rogers in Oakland, California.

This landmark case currently includes 133 personal injury claims and is titled In re: Social Media Adolescent Addiction/Personal Injury Products Liability Litigation (MDL No. 3047).

The lawsuits allege that Meta (Facebook and Instagram), Snapchat, TikTok, and YouTube analyze users’ personal data and employ algorithms to manipulate minors and keep them addicted to the product. Social media companies designed their products to work much like a drug. The lawsuits further allege that using the products deliberately affects dopamine levels in youth. As a result, these products have caused young adolescents and adults to suffer anxiety, depression, eating disorders, body dysmorphia, suicidal thoughts, suicide, sleeplessness and other severe mental and physical health disorders as a result of their addiction to social media.

An essential question in this case is whether the sites named in the suits and their algorithms can be considered “products” — and if so, whether they have design features, that are defective insofar as they cause kids to increasingly use the platforms to a greater and greater degree, and that extreme usage causes a variety of mental health problems, and whether the companies can be held liable for product designs that are charged with causing or contributing to harm.
